Terms and Conditions
OPN MANUFACTURE

1. Provider and Scope of Application
These General Terms and Conditions apply to orders placed by consumers through the OPN MANUFACTURE online shop.

The Provider is a sole proprietorship that is not registered in the Commercial Register. These General Terms and Conditions apply exclusively to contracts concluded with consumers within the meaning of Section 13 of the German Civil Code (Bürgerliches Gesetzbuch – BGB). The offer is available to customers with a delivery address in Germany.
2. Offers and Ordering Process
The presentation of products in the online shop constitutes an invitation to place an order and does not constitute a binding offer by the Provider.
Before submitting an order, customers may review their details during the checkout process and correct any input errors. By clicking the clearly designated order button indicating an obligation to pay, in particular a button labelled “Order with obligation to pay” (“zahlungspflichtig bestellen”), customers submit a binding offer to conclude a purchase contract for the products contained in their shopping cart.
The purchase contract is concluded upon submission of the order by the customer. A confirmation email subsequently sent by the Provider confirms receipt of the order and contains the order details.
3. Contract Language and Contract Information
The language of the contract is German. The product description and the information displayed in the online shop and during checkout at the time the order is placed shall be authoritative.
The order confirmation and contractual information will be sent to the email address provided during the ordering process. Customers should retain this email for their records.
4. Prices, Shipping and Collection
All prices stated in the online shop are final prices and include the applicable statutory value-added tax (VAT). Any additional shipping costs will be displayed separately during checkout before the order is submitted. The shipping costs and delivery times displayed there shall be authoritative.
Shipping is available within Germany. Collection in person is possible only by prior individual arrangement. The collection location, collection time and any applicable charges will be communicated in advance.
5. Payment
The following payment methods are offered during checkout:
- Card payment via Shopify Payments;
- PayPal
- Manual bank transfer as advance payment.
The payment methods actually available in each case will be displayed during checkout. In the case of advance payment, the invoice amount must be transferred after conclusion of the contract. The bank details will be provided in the order confirmation. Dispatch will take place once full payment has been received.
Payment processing through external payment service providers is additionally subject to their respective terms and conditions. These terms and conditions do not affect the statutory rights of customers vis-à-vis the Provider.
6. Delivery and Transfer of Risk
The estimated delivery time will be displayed in the online shop or during checkout before the order is submitted. Should an ordered product exceptionally become unavailable, the Provider will inform the customer without undue delay and refund any payments already made for products that cannot be delivered.
In the case of consumers, the risk of accidental loss of or accidental damage to the goods shall generally pass to the customer only upon delivery of the goods to the customer. Statutory exceptions remain unaffected.
7. Right of Withdrawal
Consumers are generally entitled to the statutory right of withdrawal. The electronic withdrawal function provided by the online shop may also be used for this purpose. Further details, including the withdrawal instructions and the model withdrawal form, will be provided separately and before the order is submitted.
No additional voluntary return guarantee is granted. No general restriction of the right of withdrawal on the grounds of opened outer packaging, missing original packaging or mere inspection of the goods is agreed. Statutory exceptions to the right of withdrawal and the statutory requirements governing compensation for any loss in value remain unaffected.
In the event of withdrawal, the customer shall bear the direct costs of returning the goods, provided that the applicable statutory information requirements in this regard have been fulfilled. The following address is designated for returns:

8. Retention of Title
The goods shall remain the property of the Provider until the purchase price has been paid in full.
9. Statutory Rights in Respect of Defects
The statutory rights in respect of defects shall apply. The limitation periods and rights relating to defective goods shall not be restricted by these General Terms and Conditions. No special provisions are made for used goods.
10. Liability
The Provider shall be liable without limitation for damages arising from injury to life, body or health, for damages caused intentionally or through gross negligence, for fraudulent concealment of a defect, under any guarantee expressly assumed by the Provider, and pursuant to the German Product Liability Act (Produkthaftungsgesetz).
In the event of a slightly negligent breach of a material contractual obligation, the Provider shall be liable only for damages that are foreseeable and typical for the contract in question. Material contractual obligations are those obligations whose fulfilment is essential for the proper performance of the contract and on whose compliance the customer may regularly rely.
In all other respects, the Provider's liability shall be excluded to the extent permitted by applicable law. Mandatory statutory claims and rights shall remain unaffected.
11. Applicable Law
The laws of the Federal Republic of Germany shall apply. In the case of consumers, this choice of law shall apply only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.
12. Final Provisions
Should any provision of these General Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall replace any invalid provision.

1. Anbieter und Geltungsbereich
Diese Allgemeinen Geschäftsbedingungen gelten für Bestellungen von Verbraucherinnen und Verbrauchern über den Online-Shop OPN MANUFACTURE.

Der Anbieter ist ein nicht im Handelsregister eingetragenes Einzelunternehmen. Diese AGB gelten ausschließlich für Verträge mit Verbraucherinnen und Verbrauchern im Sinne des § 13 BGB. Das Angebot richtet sich an Kundinnen und Kunden mit Lieferanschrift in Deutschland.
2. Angebote und Bestellablauf
Die Darstellung der Produkte im Online-Shop ist eine Aufforderung zur Abgabe einer Bestellung und noch kein verbindliches Angebot des Anbieters.
Vor dem Absenden der Bestellung können Kundinnen und Kunden ihre Angaben im Checkout prüfen und Eingabefehler berichtigen. Mit dem Betätigen des eindeutig zahlungspflichtigen Bestellbuttons, insbesondere eines Buttons mit der Beschriftung „zahlungspflichtig bestellen“, geben sie ein verbindliches Angebot zum Abschluss eines Kaufvertrags über die im Warenkorb enthaltenen Produkte ab.
Der Kaufvertrag kommt mit dem Absenden der Bestellung durch die Kundin oder den Kunden zustande. Eine anschließend versandte Bestätigungs-E-Mail bestätigt den Eingang der Bestellung und enthält die Bestelldaten.
3. Vertragssprache und Vertragsinformationen
Die Vertragssprache ist Deutsch. Maßgeblich sind die Produktbeschreibung und die Angaben, die im Zeitpunkt der Bestellung im Online-Shop und im Checkout angezeigt werden.
Die Bestellbestätigung und die Vertragsinformationen werden an die im Bestellvorgang angegebene E-Mail-Adresse übermittelt. Kundinnen und Kunden sollten diese E-Mail aufbewahren.
4. Preise, Versand und Selbstabholung
Alle im Shop angegebenen Preise sind Endpreise und enthalten die jeweils geltende gesetzliche Umsatzsteuer. Hinzukommende Versandkosten werden vor Abgabe der Bestellung im Checkout gesondert angezeigt. Die dort angezeigten Versandkosten und Lieferzeiten sind maßgeblich.
Der Versand erfolgt innerhalb Deutschlands. Eine Selbstabholung ist nur nach vorheriger individueller Absprache möglich. Abholort, Abholzeit und gegebenenfalls anfallende Kosten werden vorab mitgeteilt.
5. Zahlung
Im Checkout werden folgende Zahlungsarten angeboten:
- Kartenzahlung über Shopify Payments,
- PayPal
- manuelle Banküberweisung als Vorkasse.
Die jeweils tatsächlich verfügbaren Zahlungsarten werden im Checkout angezeigt. Bei Vorkasse ist der Rechnungsbetrag nach Vertragsschluss zu überweisen. Die Bankverbindung wird in der Bestellbestätigung mitgeteilt. Der Versand erfolgt nach vollständigem Zahlungseingang.
Die Zahlungsabwicklung über externe Zahlungsdienstleister richtet sich ergänzend nach deren jeweiligen Bedingungen. Diese Bedingungen ändern nichts an den gesetzlichen Rechten der Kundinnen und Kunden gegenüber dem Anbieter.
6. Lieferung und Gefahrübergang
Die voraussichtliche Lieferzeit wird im Online-Shop beziehungsweise im Checkout vor Abgabe der Bestellung angezeigt. Sollte ein bestelltes Produkt ausnahmsweise nicht verfügbar sein, informiert der Anbieter die Kundin oder den Kunden unverzüglich und erstattet bereits geleistete Zahlungen für nicht lieferbare Produkte.
Bei Verbraucherinnen und Verbrauchern geht die Gefahr des zufälligen Untergangs und der zufälligen Verschlechterung der Ware grundsätzlich erst mit der Übergabe der Ware an die Kundin oder den Kunden über. Die gesetzlichen Ausnahmen bleiben unberührt.
7. Widerrufsrecht
Verbraucherinnen und Verbrauchern steht grundsätzlich das gesetzliche Widerrufsrecht zu. Hierfür kann auch die elektronische Widerrufsfunktion des Shops genutzt werden. Die Einzelheiten, einschließlich der Widerrufsbelehrung und des Muster-Widerrufsformulars, werden gesondert und vor Abgabe der Bestellung bereitgestellt.
Es wird keine zusätzliche freiwillige Rückgabegarantie eingeräumt. Eine allgemeine Einschränkung des Widerrufsrechts wegen geöffneter Umverpackung, fehlender Originalverpackung oder einer bloßen Prüfung der Ware wird nicht vereinbart. Gesetzliche Ausnahmen vom Widerrufsrecht und die gesetzlichen Voraussetzungen für Wertersatz bleiben unberührt.
Die Kundin oder der Kunde trägt bei einem Widerruf die unmittelbaren Kosten der Rücksendung, soweit die gesetzlichen Informationspflichten hierzu erfüllt sind. Für die Rücksendung ist folgende Anschrift vorgesehen:

8. Eigentumsvorbehalt
Die Ware bleibt bis zur vollständigen Bezahlung des Kaufpreises Eigentum des Anbieters.
9. Gesetzliche Mängelrechte
Es gelten die gesetzlichen Mängelrechte. Die Verjährungsfristen und Rechte bei mangelhafter Ware werden durch diese AGB nicht eingeschränkt. Eine besondere Regelung für gebrauchte Waren wird nicht getroffen.
10. Haftung
Der Anbieter haftet unbeschränkt für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit, für vorsätzlich oder grob fahrlässig verursachte Schäden, bei arglistigem Verschweigen eines Mangels, aus einer übernommenen Garantie sowie nach dem Produkthaftungsgesetz.
Bei leicht fahrlässiger Verletzung einer wesentlichen Vertragspflicht haftet der Anbieter nur für den vertragstypischen, vorhersehbaren Schaden. Wesentliche Vertragspflichten sind solche Pflichten, deren Erfüllung die ordnungsgemäße Durchführung des Vertrags überhaupt erst ermöglicht und auf deren Einhaltung die Kundin oder der Kunde regelmäßig vertrauen darf.
Im Übrigen ist die Haftung des Anbieters im gesetzlich zulässigen Umfang ausgeschlossen. Zwingende gesetzliche Ansprüche bleiben unberührt.
11. Anwendbares Recht
Es gilt das Recht der Bundesrepublik Deutschland. Bei Verbraucherinnen und Verbrauchern gilt diese Rechtswahl nur, soweit dadurch nicht der Schutz entzogen wird, der durch zwingende Bestimmungen des Rechts des Staates gewährt wird, in dem die Verbraucherin oder der Verbraucher ihren oder seinen gewöhnlichen Aufenthalt hat.
12. Schlussbestimmungen
Sollte eine Bestimmung dieser AGB ganz oder teilweise unwirksam sein oder werden, bleiben die übrigen Bestimmungen unberührt. An die Stelle der unwirksamen Bestimmung treten die gesetzlichen Vorschriften.
